Starting March 1st, 2024, applicants in Uruguay may request the registration of new types of trademarks, in accordance with resolution 18/2023, issued by the National Directorate of Industrial Property (DNPI) on December 11th, 2023.
The following are the new registrable trademarks:
- Pattern trademarks. Trademarks comprised of a set of elements that are repeated sequentially.
- Motion trademarks. Trademarks that express movement or show a change of position of the elements that make up the mark.
- Position trademarks. The mark has a particular location in the given product.
- Multimedia trademarks. Trademarks that include or combine sound and image.
New technological advances and digitalization have been the main driving force behind these new marks, marks that are being increasingly used by organizations from all sectors as part of their commercial and branding strategies. Non-traditional trademarks have proven to be a very useful tool to approach specific market niches, generate unique customer experiences and manage a successful brand positioning strategy.
Thus, and thanks to this new resolution, these flourishing brands will be able to be properly protected in Uruguay through the Intellectual Property system. This unstoppable trend is spreading throughout Latin America. In recent years, we have seen new trademark regulations that address this type of signs being issued throughout the continent, where more novelties are expected in 2024.
In Uruguay, these signs will be governed by Trademark Law No. 17011.
