On December 5, 2023, Paraguay’s National Plant and Seed Quality and Health Service (SENAVE) reported important updates in the registration procedure of the National Register of Protected Cultivars (RNCP) and the National Register of Commercial Cultivars (RNCC). Thus, from now on, applicants for Plant Varieties in the country must take into account the following:
- The new legal documentary specifications required for the registration process in both national registries.
- The obligation to submit the certification of signatures in the responses to the notifications, both for the application and the morphological descriptor.
- The update of the resolution for the control of changes in the RNCP.
It is important to point out that, according to this update, the Power of Attorney document must be apostilled, in force, and registered at the General Directorate of Public Registries, Powers of Attorney Section. Matters such as the payment of the annuity can only be made by the agent registered as responsible for the case.
In addition, it is the applicant’s responsibility to keep the aforementioned document up to date, as it must be valid during the protection period. Unregistered or expired powers of attorney will not be accepted.
These updates are effective as of January 2, 2024.
