In the various figures, projects or coordination processes relating to industrial and intellectual property undoubtedly the European level domain .eu is one of the lesser known but that can be seen most affected, as we indicated our expert Dolores Carmona:
EFFECTS OF BREXIT DOMAIN “.EU”
The policy of registration of a “.eu” domain determines a number of requirements as to who is considered to be the holder of a .eu domain, the regulation establishes textually: “the Contractor must verify whether it meets the General Eligibility Criteria , among others:
• A company that has its registered office, central administration or principal place of business in the European Union, Norway, Iceland and Liechtenstein Union, or
• An organization established in the European Union, Norway, Iceland and Liechtenstein Union without prejudice to national law, or
• A natural person resident in the European Union, Norway, Iceland and Liechtenstein
If the Contractor fails to meet one of the eligibility criteria above shall not be entitled to register a domain name. If you submit an application for registration of a domain name but can not meet or no longer meets the above conditions, the Register may at any time reject the application or revoke the Domain Name in question .
Therefore, pursuant to the above if it is anticipated that the records requested a .eu domain name of an individual or company resident in the UK may be affected by the Brexit.
EURid itself, which is the record that manages top level domains with .eu country code and that once it was approved by the European Commission itself has published on its website the following news:
“On 23 June 2016 voters in the referendum in the UK expressed a preference to leave the European Union. As the next steps have not yet been determined and have not yet begun political and legal processes, note that no action will be taken against the .eu domain names they have been registered by residents in the UK .
EURid has been appointed by the European Commission to operate the .eu technical infrastructure. When more details on the timing and details of a departure from the UK are known, the European Commission EURid will instruct on how to proceed. “
Therefore we will be very attentive to the news published on this matter, and certainly the scenario that is set to be a transition period to avoid loss of rights.
