Trademark Protection in Latin America: ClarkeModet’s Success in Coca-Cola FEMSA’s KOF Project

The Challenge

The project consists of the launch of new trademarks in Latin America that are part of its innovation proposal for the development of a new experience for its clients. Coca-Cola FEMSA needed to have the infrastructure to manage the protection of its trademark portfolio of trademarks abroad under an integral IP strategy.

ClarkeModet joins this project, through the strategic definition for the protection of the trademark portfolio of this new business line that will be able to position itself in the countries where they were registered. For this purpose, they had to understand the need of Coca-Cola FEMSA of unifying the protection scope in all target jurisdictions. Indeed, they would have to face the management of a large portfolio and great complexity in view of the different regulations.

The Solution

ClarkeModet approached a strategy through its distinguishing feature: the centralization of business, doing so from the Mexican subsidiary, by means of a single contact and a single administrative model.

The strategy was developed to operate 550 managements of trademark registration, for their protection in 5 different classes with the purpose of broadening their protection to their full potential, and thus be able to fully shield the project’s implementation.

In addition to this, the importance of weekly monitoring the trademark portfolio was raised, to identify any attempt to use a similar or identical trademark to uphold the law.

The submission for registration of the 550 managements, despite the complexity involved in carrying out the protection in the different jurisdictions. ClarkeModet helped Coca-Cola FEMSA in implementing agile and efficient management for protecting their rights. The monitoring that was developed has managed to maintain the protection and generate effective communication between both parties.
